Transparent about our agreements

These terms and conditions apply to all treatments and services provided by Tandarts Leidseplein. They have been drawn up in accordance with the Dutch Medical Treatment Contracts Act (WGBO), the Quality, Complaints and Disputes in Healthcare Act (Wkkgz), and other applicable Dutch legislation.

General

These terms and conditions apply to all agreements between Tandarts Leidseplein and its patients. By using our services, you confirm that you have read and agreed to these terms.

Governing law — All agreements are governed exclusively by Dutch law. Disputes are submitted exclusively to the competent court in Amsterdam or to the Healthcare Disputes Committee (Geschillencommissie Zorg).

Treatment Agreement

The relationship between Tandarts Leidseplein and its patients is governed by the Dutch Medical Treatment Contracts Act (WGBO, BW 7:446 et seq.). Every treatment is carried out only with your informed consent.

Informed consent (Art. 7:450 BW) — We do not perform any treatment without your prior, informed consent. You will receive timely information about the nature and purpose of the treatment, the expected risks, and any alternatives.
Treatment plan — For extensive treatments, we draw up a treatment plan describing the proposed treatment, the costs, and the expected duration. You must confirm this plan before treatment begins.
Right to refuse — You have the right to refuse a proposed treatment or to discontinue an ongoing treatment at any time, without any adverse consequences for your further care at our practice.
Patient cooperation — To enable us to provide the best possible care, we expect you to provide complete and accurate information about your health, medication use, and relevant medical history.

Appointments & Cancellation

We plan our appointments carefully to provide you with optimal care. To safeguard appointment availability for all patients, we apply the following cancellation policy.

Timely cancellation — Appointments must be cancelled at least 24 hours in advance by telephone (+31 20 62 55 930) or email ([email protected]).
Late cancellation or no-show — If you cancel less than 24 hours in advance or fail to attend an appointment (no-show), we may charge a fee for the reserved treatment time. You will be notified of any applicable fee in advance.
Late arrival — If you arrive more than 10 minutes late, we may need to reschedule or shorten your appointment to avoid inconveniencing other patients.
Appointment reminder — We will send you a reminder message before your appointment. Please let us know as soon as possible if you are unable to attend.

Pricing & Payment

Our fees for insured dental care are based on the tariffs set by the Dutch Healthcare Authority (Nederlandse Zorgautoriteit, NZa). For uninsured and cosmetic treatments, we apply our own pricing, which is communicated in advance.

NZa tariffs — For regular dental care, we apply the maximum tariffs set by the NZa. You can request our current price list from the practice or consult nza.nl.
Private and cosmetic treatments — Treatments not covered by your basic health insurance — such as aesthetic procedures, implants, and orthodontics — are quoted in advance. You will receive a written cost estimate for your approval.
Payment terms — Invoices must be paid within 30 days of the invoice date. If this deadline is exceeded, statutory interest applies in accordance with Art. 6:119 of the Dutch Civil Code.
Debt collection — In the event of late payment following a reminder, collection costs will be charged in accordance with the Dutch Act on normalisation of out-of-court collection costs (WIK). In such cases, we will refer your account to a collection agency.

Health Insurance & Reimbursements

We work with all Dutch health insurers. The reimbursement you receive depends on your policy and supplementary insurance. It is your own responsibility to check which treatments are covered by your insurer.

Direct billing — We bill insured care directly to your health insurer wherever possible, using your Citizen Service Number (BSN) and insurance details.
Excess and co-payment — Dental care for adults is generally not subject to the compulsory deductible. Your supplementary dental insurance determines your reimbursement. Any portion not reimbursed will be invoiced directly to you.
Uninsured treatments — Treatments not covered by your insurer are entirely at your own expense. We will inform you of this in advance so you can make an informed choice.
Coverage limit — For treatments subject to an annual reimbursement cap, we will notify you when you are approaching your yearly maximum so you can consult your insurer in time.

Liability

All dentists and staff at Tandarts Leidseplein are registered in the BIG register (Dutch Act on individual healthcare professions) and practise in accordance with the guidelines of the KNMT (Royal Dutch Dental Association).

Best-efforts obligation — We commit to providing care of a good standard in accordance with the professional standard. Our obligation is one of best efforts, not one of guaranteed results.
Limitation of liability — Our liability is limited to direct damages and to the amount paid out by our professional indemnity insurance in the relevant case.
Exclusion of indirect damages — Tandarts Leidseplein is not liable for indirect damages, consequential damages, or lost income resulting from a treatment or the absence thereof.
Force majeure — We are not liable for failure to fulfil our obligations as a result of force majeure, including illness of practitioners, emergencies, or government measures.

Complaints Procedure

We attach great importance to patient satisfaction. If you have a complaint about our care or services, we ask you to raise it with us directly first. Under the Wkkgz, you are entitled to an accessible complaints procedure.

Step 1 — Direct contact — Discuss your complaint with your treating dentist or the practice manager. We aim to address your complaint within 5 working days.
Step 2 — Complaints officer — If you cannot resolve the matter with the practice, you may submit your complaint to our independent complaints officer (klachtenfunctionaris). We are required to provide this under the Wkkgz. Details of the complaints officer are available on request.
Step 3 — Healthcare Disputes Committee — If your complaint is not resolved to your satisfaction through the complaints officer, you may submit your dispute to the Geschillencommissie Zorg (geschillencommissiezorg.nl). The ruling is binding on both parties.
Disciplinary proceedings — You also have the option of filing a complaint with the Regional Disciplinary Board for Healthcare (Regionaal Tuchtcollege voor de Gezondheidszorg) if you believe a BIG-registered professional has violated professional standards.

Patient Rights

As a patient, you have a number of fundamental rights under the WGBO. We respect and support the exercise of these rights.

Right to information (Art. 7:448 BW) — You have the right to receive clear, understandable information about your dental situation, the proposed treatment, potential risks, and alternatives.
Informed consent (Art. 7:450 BW) — We do not perform any treatment without your free and informed consent. For patients under 16 years of age, consent from a parent or guardian is also required.
Access to your record (Art. 7:456 BW) — You have the right to inspect your dental record and receive a copy. Requests are handled within 4 weeks.
Right to a second opinion — You are always entitled to request a second opinion from another dentist or specialist. We will provide the necessary information upon request.

Personal Data

For the performance of the treatment agreement, we process your personal data, including medical and dental data. We do so in compliance with the General Data Protection Regulation (GDPR) and the WGBO.

Your rights — You have the right to access, rectification, erasure (subject to the WGBO retention obligation), restriction, data portability, and objection. Requests can be submitted to [email protected].
Confidentiality — All our staff are bound by a professional and contractual duty of confidentiality with respect to your medical data.

Changes & Governing Law

Tandarts Leidseplein reserves the right to amend these terms and conditions. Amended terms will be published on our website at least 30 days before they take effect and, where applicable, communicated by email to existing patients.

Entry into force — Amended terms take effect 30 days after publication, unless a shorter period is legally required or necessitated by circumstances.
Governing law — All agreements with Tandarts Leidseplein are governed exclusively by Dutch law.
Competent court — Disputes not resolved through the complaints procedure or the Healthcare Disputes Committee are submitted exclusively to the competent court in the district of Amsterdam.
